I always hoped to see a discussion about law's spirit vs letter of the law. While it seems more ethical to follow spirit of law, many legal systems gives priority to letter of law. One reason is that people can have different translation of spirit of law over time. For example in DW speaking of other online games are against the rules. It was a time that it includes all games with online features. Then later with change of head admin it follows the spirit of the law and only include the online game who is competitor of OGN (so people can speak of games such as Starcraft). Is this fair to people who got jailed or banned with former definition? Plus spirit of law definition depend on human judgement and common sense and that common sense maybe not same common sense over time. Slavery was a correct act by common sense at some point, does it make it correct or ethical now? Common sense and spirit of law can change over time and by changing GH, so is that really the best way to judge people? |
