You actually asked 3 questions


1) If we have a soul again depends on the definition of soul being used. Since there are a number of philosophers and theologians that equate the soul with the mind or even with an individual's personal identity, or any number of other possibilities, I would say yes, we have souls. Where the question actually gets complicated is not 'if we have souls' but if the soul is immortal (survives the death of the body) or if it is divine (God given)

2) Given that the premise of the discussion is a Faustian arrangement then yes, for the purposes of this discussion, if we have souls they are tradeable. If the premise of a Faustian arrangement was not present however, the possibility of trading a soul becomes more difficult as you then have to consider questions related to the existence of divine beings before you can even approach whether or not the soul is tradeable.

3) Of course someone could (if once again accepting the premise of a Faustian arrangement) give their soul away freely. But my points where not about if someone could give/trade their soul, they where if someone could give/trade their soul and be justified for functional or moral reasons in doing so. Based on those argument, an individual who gives their soul away would not be justified functionally, although they could still be somewhat morally justified under altruism (self-sacrifice) depending on the situation. Under most cases however, I do not think they would be justified under your given scenario.


You have raised an interesting area of additional thought though... the Faustian arrangement and informed consent. The Faustian arrangement is of course a contract, and contracts in the physical world are made null and void if the person is not in their right mind (too drunk, high, or whatever). The traditional Faustian arrangement is complicated by this since the deal maker is typically the 'trickster' of whatever religion is in question (Satan, Loki, Pan, Hades, etc.). Since most of these deals are based on trickery, then informed consent is questionable. Even with a Faustian deal there is always small print.
