Subject: 3) Where does the right come from?
Humans seem to be autonomous individuals, and yet as a species require a certain level of interaction with others to properly develop. It is this combination of factors that directly leads to privacy because it is the amount of our autonomy that we forgo in order to have these relationships (on varrying scales depending on the individuals involved) that we need so much. Moore's aformentioned paper address the idea of privacy existing across cultures or even species. He explains the difference of privacy and seclusion (free will is what turns seclusion into privacy) and how many species of animals at least practice seclusion, and how all cultures have at least some kind of privacy interwoven into their culture/society. So the level of privacy is relative depending on the culture, but they all have it to some degree because with out it, it would be impossible to have social relationships or personal development (Moore, 2003, 220-222). It is this universal existence of privacy that allows it to transcend just being a government/legal right and allows it to be a moral/ethical right (either social/cultural or personal). Some countries like Canada recognize this and have explicit privacy rights (Constitution & Canadian Charter of Rights and Freedoms). Others like the USA do not explicitly mention privacy, but the right is defended through other rights like free speech, private property, and liberty (Constitution & Bill of Rights). Some countries do no have privacy laws at all, yet the right itself can still be found between individuals.
