1- Rule vs Legal system
I disagree with you. Since some jailed people are referred to legal authorities and people are spending real money and time on this game the rules should follow legal system. (US legal system since OGN registered in US and in rules they are mentioning court of Michigan state).

2- The fact that the rules takes time to write or read is an excuse. Any commercial sites with social interaction should have an online terms and agreements. Those terms and agreements will include specified rules of the website. I hope no one wants to use Beta excuse here after that many years of game functionality.
Basically because OGN is a registered commercial company, they need a lawyer to write them complete terms and agreement with rules and consequences of breaking them.

3- If you want to base a rule (community failure) to common sense , you will have many flows in different levels.

First , common sense is different from person to person and culture to culture. Unlike letter of laws which clarify laws of US and Michigan state as based definition, a common sense is based on a person culture , should I mention the differences in each culture ?

Second, the sprite of law will depend on one person judgment. No matter how much a person is a good and nice person, he can make mistakes.

Third, about fairness, no warning makes such jail times fair. Because the law is not cleared for everyone from start, they may spend money on DW. Now when they warned about an uncleared rules after spending, they don't have the option to return the character and get their money back, do they? But if the rules (in term and agreements) are cleared and based on letter of law (so everyone can understand how exactly they work) the spending (money or time) will be the player responsibility.

Forth, community failure is not the only rule with clarification problem. When we have rules we should have exact defined of punishment for breaking the rules and people should be notified in advance of those punishment. A quick look to jail shows that people are getting different sentences for same rule breaking. For example, rules should clarify that each multie has X amount of days of jail and after Y times jail will increase with this formula.
